## 2. Services provided by Vincent Color Film
Vincent Color Film creates and sells digital products and educational resources for filmmakers, photographers, editors, colorists, and other creative professionals.
Our Products and Services may include, among other things:
• LUTs and color grading tools;
• PowerGrades;
• Lightroom presets;
• film overlays and film grain;
• film burn transitions;
• sound effects and audio assets;
• visual effects;
• digital bundles;
• downloadable guides and resources;
• practice footage;
• tutorials;
• online masterclasses and educational content; and
• other digital filmmaking and photography tools.
Collectively, these are referred to as the “Products” or “Services.”
Product contents, compatibility, technical requirements, access methods, and other specifications are described on the applicable Product page.
You are responsible for checking that a Product is compatible with your software, hardware, camera profile, editing platform, or workflow before purchasing it.

## 3. Intellectual property rights and license
### 3.1 Intellectual property rights
All content available through Vincent Color Film, including but not limited to LUTs, PowerGrades, presets, overlays, transitions, sound effects, videos, masterclass materials, practice footage, graphics, photographs, text, logos, tutorials, downloadable files, and website content, is owned by Vincent Color Film or used with permission from the relevant rights holder.
All such content is protected by copyright, trademark, and other applicable intellectual property laws.
Purchasing a Product does not transfer ownership or copyright in the Product to you.
You receive only the usage rights expressly granted under these Terms or stated on the applicable Product page.
### 3.2 Digital Product License
Unless otherwise stated on a Product page, purchasing a digital Product grants you a non-exclusive, non-transferable, non-sublicensable, worldwide license to use that Product in accordance with these Terms.
You may use purchased creative assets in your own personal and commercial creative work, including:
• films and videos;
• advertisements;
• branded content;
• social media content;
• client projects;
• photography;
• websites;
• presentations;
• music videos;
• documentaries;
• short films;
• commercial productions; and
• other finished creative projects.
You may use Products in an unlimited number of finished projects unless a Product page specifically states otherwise.
For example, you may apply a purchased LUT to footage for a commercial client, use a sound effect in a finished video, use an overlay in an advertisement, or use a Lightroom preset when editing photographs.
The license applies to the finished work created using the Product, not to the underlying Product files themselves.
### 3.3 Prohibited use and redistribution
You may not:
• sell, resell, sublicense, distribute, share, upload, transfer, or give away the original Product files;
• make Product files available for download by another person;
• share your download links with unauthorized third parties;
• redistribute Products through cloud storage, file-sharing platforms, marketplaces, asset libraries, websites, social media groups, or similar services;
• include the original Product files in another downloadable product, template, bundle, course, asset pack, software product, or digital resource;
• modify a Product and sell or distribute the modified version as a standalone asset;
• claim ownership or authorship of the original Product;
• use Products to create a directly competing LUT pack, preset pack, PowerGrade pack, sound pack, overlay pack, transition pack, educational product, or other asset library;
• reverse engineer or extract Products for the purpose of creating substantially similar competing assets; or
• use the Products in any unlawful, fraudulent, defamatory, misleading, or rights-infringing manner.
You may deliver a finished exported project to a client.
However, unless otherwise expressly agreed, you may not provide the client with the original Vincent Color Film Product files themselves.
### 3.4 Client work
Freelancers, filmmakers, photographers, editors, colorists, agencies, and other creative professionals may use Products when creating finished work for clients.
For example, you may use a LUT, PowerGrade, overlay, transition, sound effect, or preset in a commercial production for a client.
The client may use the resulting finished work.
The client does not automatically obtain a license to the underlying Vincent Color Film Product files.
If the client requires access to the original Product files for its own future use, a separate purchase may be required.
### 3.5 Masterclass and educational content
Access to masterclasses, tutorials, lessons, downloadable educational materials, and other educational Products is intended for the purchaser only unless expressly stated otherwise.
You may not:
• reproduce or redistribute lessons;
• screen-record and distribute course content;
• upload course videos to another platform;
• resell or sublicense course access;
• distribute PDFs, guides, templates, or other educational resources to third parties; or
• use the course materials to create or reproduce a substantially similar competing course.
Downloaded practice footage supplied as part of a masterclass is intended for personal educational and practice purposes unless the applicable Product page expressly grants broader usage rights.
Practice footage may not be resold, redistributed, licensed, uploaded to stock platforms, or represented as footage created or owned by you.
### 3.6 Lifetime access and updates
Certain Products may be advertised as including “lifetime access,” “lifetime updates,” or similar wording.
Where such wording is used, it means that you will not be charged a recurring subscription fee for continued access to the applicable Product and that access will remain available for as long as Vincent Color Film continues to make that Product or associated delivery method available, subject to these Terms.
Where lifetime updates are expressly included with a Product, updates made available for that specific Product will be provided to eligible purchasers without an additional charge unless otherwise clearly stated.
Lifetime access does not guarantee that a particular third-party platform, software version, hosting provider, file format, feature, or download method will remain available indefinitely.
We may change the technical method through which Products are delivered or accessed.

## 5. Prices and payments

## 7. Cancellation, withdrawal and refunds
### 7.1 Digital content
Our Products are generally supplied digitally and access may begin immediately after purchase.
Where applicable under consumer law, by requesting immediate access to digital content before the expiry of a statutory withdrawal period, you expressly consent to the immediate performance of the agreement.
Where required by law, you also acknowledge that your statutory right of withdrawal may be lost once delivery or access to the digital content has begun.
As a result, purchases of digital Products are generally final once the files, download link, course access, or other digital content have been made available to you.
### 7.2 Refund requests
Due to the nature of digital Products, we generally do not provide refunds, returns, or exchanges simply because you:
• changed your mind;
• purchased the wrong Product;
• no longer need the Product;
• do not like the creative result;
• did not check software compatibility;
• lack the required software or hardware; or
• have already downloaded or accessed the Product.
However, this does not affect any mandatory rights you may have under applicable consumer protection law.
If there has been a genuine problem with your purchase, such as:
• duplicate payment;
• receiving the wrong Product;
• a corrupted or unusable file;
• a technical issue preventing access; or
• another material defect,

We may provide technical assistance, replacement files, alternative access, or a refund where appropriate.
### 7.3 Effect of a refund
If a refund is approved, your license to the refunded Product is automatically revoked.
You must immediately stop using the Product and permanently delete all copies in your possession or control.
Any remaining access to the Product may also be revoked.

Third-party products and trademarks belong to their respective owners.
Unless expressly stated otherwise, Vincent Color Film is not affiliated with, sponsored by, or endorsed by third-party software or hardware manufacturers.
You are responsible for checking the Product page and ensuring that you have compatible software, hardware, and technical knowledge before purchasing.
Software companies may change their products, file formats, operating requirements, features, or compatibility after a Vincent Color Film Product is released.
We cannot guarantee permanent compatibility with every future version of third-party software.
